DMCA Policy & Copyright Infringement Notification

AkulTalkies.com ("we," "us," or "our") operates the website www.akultalkies.com (the "Site"). We respect the intellectual property rights of others and expect our users to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA").
Protection of intellectual property is of utmost importance to us and we ask our users and their authorized agents to do the same. It is our policy to expeditiously respond to clear notifications of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (“DMCA”) of 1998, the text of which can be found on the U.S. Copyright Office website.
This DMCA Policy describes the information that must be included in a copyright infringement notice ("DMCA Notice") and the actions we take upon receiving a valid notice.
  1. Our Role
    Akul Talkies is an informational entity that provides details about movies, television series, web series, and OTT content. We may host third-party content, such as promotional images, posters, or user-submitted commentary.
    We do not knowingly host illegally uploaded video files. If we link to streaming platforms, we aim to link only to official, authorized sources (e.g., Netflix, Amazon Prime, Hotstar). However, we cannot control content hosted on third-party websites.
  2. Submitting a DMCA Notification of Claimed Infringement
    If you are a copyright owner or an agent thereof, and you believe that any content hosted directly on our Site infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent (listed below) with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):
    1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
    2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on the Site are covered by a single notification, a representative list of such works.
    3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit AkulTalkies to locate the material.
      Note: The best way to help us locate the material is to provide the specific URL(s) on our Site where the content is located.
    4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address.
    5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
    6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
    7. The DMCA requires you to provide your personal information in the copyright infringement notification. If you are concerned about the privacy of your personal information, you may wish to use an agent to report infringing material for you.
  3. Designated Copyright Agent Contact Information

    Please note that if you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA Notice may not be effective.
  4. Our Response to Valid DMCA Notices
    Upon receipt of a valid DMCA Notice, AkulTalkies will take the following steps expeditiously:
    1. Remove or disable access to the material that is alleged to be infringing.
      Filing a DMCA complaint is the start of a pre-defined legal process. Your complaint will be reviewed for accuracy, validity, and completeness. If your complaint has satisfied these requirements, our response may include the removal or restriction of access to the allegedly infringing material.
    2. Take reasonable steps to notify the alleged infringer (if the content was posted by a user) that we have removed or disabled access to the material.
    3. Notwithstanding anything to the contrary contained in any portion of this Policy, the Operator reserves the right to take no action upon receipt of a DMCA copyright infringement notification if it fails to comply with all the requirements of the DMCA for such notifications.
    Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages (including costs and attorneys' fees).
  5. Counter-Notification Procedures
    If you are a user of our Site and material that you posted has been removed due to a DMCA Notice, and you believe that the material was removed as a result of mistake or misidentification, you may file a counter-notification.
    To be effective, a counter-notification must be a written communication provided to our Designated Agent that includes substantially the following:
    1. Your physical or electronic signature.
    2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
    3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
    4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address is located (or if you are outside of the United States, for any judicial district in which AkulTalkies may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
    If we receive a valid counter-notification, we may send a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against the provider of the material, the removed material may be replaced, or access to it restored, in 10 to 14 business days after receipt of the counter-notification.
  6. Repeat Infringer Policy
    In accordance with the DMCA and other applicable laws, Akul Talkies has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, subscribers or account holders who are deemed to be repeat infringers. We may also limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
  7. Updation and Modification
    We reserve the right to modify this Policy or its terms related to the Website and Services at any time at our discretion.
    An updated version of this Policy will be effective immediately upon the posting of the revised policy unless otherwise specified. Your continued use of the Website and Services after the effective date of the revised Policy (or such other act specified at that time) will constitute your consent to those changes.
